As of December 1, 2006, several revisions of the federal rules of civil procedure went into effect. The updated rules require that opposing counsel meet and confer to discuss discovery matters 21 days prior to a Rule 16(b) scheduling conference. In this meeting, they must develop a plan for the preservation and review of any electronically stored information that may be requested during discovery.
